Payment Terms
By using the Pickleheads app, you agree to the following terms and conditions related to payments. These terms ensure transparency and fairness while outlining the responsibilities of all parties involved.
1. Service Fees and Payment Processing
Pickleheads allows users to collect payment from other users solely for access to a pickleball session or membership in a pickleball group in accordance with these Terms of Use and all applicable laws. These users ("Organizers") may charge other users one-time session fees or monthly or annual membership fees, and other users will pay these fees prior to their participation in such sessions or groups. Organizers are responsible for providing accurate and up-to-date information about their pickleball sessions or groups, including pricing, availability, and any specific rules or requirements for participation, and Organizers must ensure that their sessions or groups comply with all applicable laws and regulations. Pickleheads does not make any representations or warranties regarding the quality, safety, or legality of pickleball sessions or groups hosted by Organizers. Users participate in sessions or groups at their own risk and agree that Pickleheads will not be liable for any injuries, damages, or other liabilities that may arise from such participation.
Pickleheads imposes a service fee equal to 7% of the session or membership price, capped at $10 USD (or equivalent) (the āService Feesā). Players pay these Service Fees in addition to the session or membership fee charged by the Organizer. These Service Fees are non-refundable and support the development and operation of the Pickleheads platform.
Payment processing for all transactions on the Pickleheads platform is facilitated through Stripe. Stripeās processing fee (~2.9% + $0.30 USD) is billed to the player at checkoutānothing is deducted from the Organizerās payout. Organizers who use this feature will create an account with Stripe and be subject to Stripeās terms and conditions. Detailed information about Stripeās processing fees is accessible via the Stripe dashboard and support resources.
By entering your credit card information, you authorize Pickleheads to securely store your payment method and charge it for future sessions, memberships, or other applicable fees associated with your use of the platform.
All applicable fees will be transparently disclosed to users by Pickleheads prior to completing any transactions.
Subscription Payments. In addition to the Organizer-hosted sessions and memberships described above, Pickleheads also offers subscription products (āSubscriptionsā) which provide access to platform features, capabilities, or benefits (e.g., Plus, Pro, Ultra tiers). These Subscriptions may be purchased via our website (processed by Stripe), via the iOS App Store (processed by Apple), or via the Android Google Play Store (processed by Google). The terms of billing, renewals, cancellations, refunds and chargebacks for Subscriptions are described in Sections 4 and 5 below.
2. Organizer Revenue and Stripe Handling
All fees for pickleball sessions or memberships must be processed through Stripe.
Organizers will receive 100% of the session or membership price they set. All fees (Pickleheads Service Fee and Stripe fee) are collected from the player at checkout.
All tax documentation and obligations related to financial transactions processed through Stripe will be managed by Stripe. Organizers should refer to Stripe for any tax-related inquiries and must ensure compliance with local tax regulations.
3. Financial Responsibilities
Organizers should set session or membership prices knowing that they will receive the full amount. Service and Stripe fees are charged to the player.
Players must understand all fees applied to their transactions before confirming any payments. By using the platform, players acknowledge their financial responsibility for all transactions made using their payment method.
4. Subscription Billing, Renewal, Channel Specifics
4.1 Billing and Renewal
Subscriptions purchased via our website (processed by Stripe) will automatically renew at the end of each billing period (monthly or annual as specified) unless cancelled. Users are responsible for cancelling their Subscription prior to renewal if they do not wish to continue.
Subscriptions purchased via the iOS App Store (Apple) or the Android Google Play Store (Google) are billed by Apple or Google (as applicable), and your renewal terms are determined by the respective store. You must manage your Subscription through your Apple ID subscription settings (for iOS) or your Google Play subscriptions (for Android).
4.2 Cancellation
- Website (Stripe): You may cancel your Subscription at any time via your Pickleheads account settings. Cancellation takes effect at the end of the current billing period and there is no pro-rata refund for unused time unless required by law.
- iOS (Apple): You must cancel your Subscription via the Apple App Store; Pickleheads cannot cancel on your behalf.
- Android (Google): You must cancel your Subscription via Google Play; Pickleheads cannot cancel on your behalf.
4.3 Price Changes
Pickleheads reserves the right to change Subscription pricing. If we do so, we will provide advance notice and your renewal will be charged at the then-current price unless you cancel before the renewal date. For Subscriptions billed via Apple or Google, the applicable storeās policies also apply.
5. Refunds & Chargebacks for Subscriptions
5.1 Website (Stripe) Subscriptions
For Subscriptions purchased via the website, refunds are processed by Pickleheads in accordance with our Refund Policy (see āRefund Policyā). Unless otherwise required by law, no pro-rata refunds will be provided for unused portions of a billing period.
5.2 Apple App Store Subscriptions
For Subscriptions purchased through the iOS App Store, billing, refunds, disputes and chargebacks are handled exclusively by Apple. You must request any refund or dispute directly through Apple; Pickleheads cannot override Appleās decision.
5.3 Google Play Subscriptions
For Subscriptions purchased through Google Play, billing, refunds, disputes and chargebacks are handled exclusively by Google. You must request any refund or dispute directly to Google; Pickleheads cannot override Googleās decision.
6. Refund Policies
By using payment features on Pickleheads, users agree to our standard Refund Policy.
Pickleheads reserves the right to amend this refund policy at any time. Any changes will be effectively communicated through updates on our website and mobile app. It is recommended that users regularly check these platforms for any updates to our refund policy.
7. Chargebacks and Consequences
Organizers are solely responsible for managing and addressing any chargebacks related to sessions or memberships. If a chargeback is filed by a player, the Organizer is required to handle the dispute directly with the player or through Stripe. Organizers are responsible for any costs or fees associated with the chargeback, including the Service Fees and the Stripe fees.
For Subscriptions billed via Apple or Google, chargebacks are governed by Appleās or Googleās policies and handled through the store. Repeated chargeback abuse or failure to follow store policies may result in termination of your account.
In instances where a player initiates a chargeback on a valid payment, after the matter has been investigated and deemed to be without merit, Pickleheads reserves the right to take disciplinary actions against such players. This may include suspending or terminating their account and access to the platform. Pickleheads aims to maintain a fair and trustworthy environment for all users and will not tolerate abuse of the chargeback process.
Organizers must immediately notify Pickleheads upon receiving a chargeback. Organizers must provide evidence supporting the legitimacy of the transaction, such as proof of service delivered or agreement terms accepted by the player. Pickleheads may, in its sole discretion, provide support to Organizers in dispute resolution by facilitating communication or providing transaction details but is not responsible for resolving the chargeback itself.
Pickleheads retains the right to intervene in disputes related to chargebacks if deemed necessary to preserve the integrity of the platform. If repeated incidents of chargebacks occur involving an Organizer, Pickleheads reserves the right to review and terminate the Organizer's or Player's ability to use the platform.
8. Amendments
Pickleheads reserves the right to modify these Payment Terms and Conditions at any time. Changes will be communicated through the app or website, and continued use of the platform constitutes acceptance of the revised terms.
By using Pickleheads, you acknowledge and agree to these Payment Terms and Conditions.
9. Platform Liability
Pickleheads acts solely as a facilitator for transactions between organizers and players. Pickleheads disclaims all liability for any financial damages, unauthorized transactions, or other monetary losses arising from the use of its platform. Pickleheads will not be liable for any injuries, damages, or other liabilities that may arise from participation in sessions or groups organized by users.
For Subscriptions, Pickleheads similarly disclaims liability for billing, refunds or chargeback outcomes handled by Apple or Google.
10. Liability & Indemnification
Pickleheads acts solely as a facilitator for transactions between Organizers and Players. Pickleheads disclaims all liability for any financial damages, unauthorized transactions, or other monetary losses arising from the use of its platform. Pickleheads will not be liable for any injuries, damages, or other liabilities that may arise from participation in sessions or groups organized by users.
By using the Pickleheads platform, you agree to defend, indemnify, and hold Pickleheads harmless, including its subsidiaries, affiliates, and all respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the payment features on the Pickleheads platform; (2) any violation of these Payment Terms; (3) any breach of your representations or warranties made herein; (4) your violation of any third-party rights, including but not limited to intellectual property rights; or (5) any harmful or fraudulent actions taken by you that impact other users of the platform.
Notwithstanding the foregoing, Pickleheads reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding that is subject to this indemnification upon becoming aware of it.
